Writ petitions filed at SC against ordinance to split political parties

KATHMANDU: Separate writ petitions have been filed at the Supreme Court against the ordinance brought by the government with an aim to make it easy for dissidents to split their mother parties.

Advocates Shreekanta Baral, Prabesh KC, Anup Aryal and Sakuntala Bhusal among others filed separate writ petitions today.

The Sher Bahadur Deuba-led government on Tuesday brought the ordinance to facilitate the Madhav Nepal faction to split from the main opposition CPN-UML.

After the issuance of the ordinance, the Nepal faction filed an application at the Election Commission to register a new party, CPN-UML Socialist.  Similarly, the Mahantha Thakur-Rajendra Mahato faction of the Janata Samajbadi Party-Nepal also applied for registration at the Election Commission seeking a new party, Janata Samajbadi Party-Nepal (Loktantrik).

The advocates filed the writ petitions arguing that the government brought the ordinance with mala fide intention  by ending the ongoing session of the Parliament.

They claimed that the ordinance, issued in an unconstitutional and undemocratic manner by deceiving the Parliament, has promoted political instability in the country. The government brought the ordinance against the recent decision of the Supreme Court, they further claimed.
